The following terms and conditions apply:

§ 1 Scope

1.1 These General Terms and Conditions (GTC) govern the contractual relationship between you as the customer and us as the provider of the platform www.cyberdoll.de. They apply to all customers of our platform regardless of whether you are acting as a consumer, entrepreneur or merchant.

1.2 We do not recognize any deviating terms and conditions unless we have expressly agreed to their validity in advance.

1.3 Registration and use of our services is reserved exclusively for persons of legal age who are fully capable of entering into contracts and who have reached the age of 18.

1.4 All agreements made between you as the customer and us in connection with a purchase or service contract are set out in these General Terms and Conditions, our order confirmation and our acceptance declaration.

1.5 The version of these General Terms and Conditions valid at the time of conclusion of the contract shall apply.

1.6 We do not recognize any differing terms and conditions of our customers, even if we do not expressly object to their validity.

1.7 The product descriptions, character traits, and photos of the models (love dolls/sex dolls) displayed on www.cyberdoll.de are fictitious and do not constitute guaranteed characteristics or performance. The models are not capable of performing the described functions independently. Outfits and accessories shown are for illustrative purposes only and are not included in the delivery. Delivered clothing or accessories may differ from the photos in color, design, and details.

§ 2 Member account / Registration with Cyberdoll

2.1 To use Cyberdoll's services, you need to create a personal member account. Registration is free.

2.2 Only natural persons of legal age (18 years and older) and legal entities are eligible to register. For legal entities, registration must be carried out by an authorized representative. Registration on behalf of third parties without their express consent, as well as the simultaneous use of multiple accounts by a single person, is prohibited.

2.3 Registration on our platform is completed by entering a valid E-Mail address. After clicking "Continue," a six-digit confirmation code will be sent to the specified address. For security reasons, this code is only valid for 15 minutes and can then be requested again. Important: For security reasons, this process is repeated with every login – this means that customers will receive a new six-digit code by E-Mail each time they register and must enter it to access their member account. This ensures that only the respective customer has access to their profile – without a password.

2.4 After registration, the following contact details must be entered and saved in the personal customer area: country, first name, last name, (optional: company name), postal code, city, and a telephone number. The E-Mail address used for login cannot be changed later.

2.5 Customers are obligated to provide complete and truthful information during registration. Important contact information can be updated at any time in the member account. Cyberdoll reserves the right to investigate or block the account in cases of reasonable suspicion of incorrect or abusive information.

2.6 Access data must be treated confidentially and protected from unauthorized access by third parties. Sharing access data is prohibited. Cyberdoll must be notified immediately in case of suspected misuse or unauthorized use. Member accounts are personal and non-transferable.

2.7 There is no entitlement to the opening of a member account. Cyberdoll reserves the right to refuse registration in individual cases without giving reasons. In this case, you will be notified promptly.

2.8 Upon completion of registration and activation of the account by Cyberdoll, a user agreement is concluded between the customer and Cyberdoll. The General Terms and Conditions, the Privacy Policy, and the Cancellation Policy become part of this agreement.

2.9 Re-registration is generally possible at any time, provided that the previous account was not blocked or terminated due to a violation of our terms of use.

§ 3 Amendment of the General Terms and Conditions (GTC)

3.1 Cyberdoll reserves the right to amend these Terms and Conditions at any time with future effect. Customers will be informed of planned changes by E-Mail at least four weeks before they come into effect. The amended passages will be clearly highlighted.

3.2 The notification will specifically draw attention to the four-week deadline and the significance of failing to object. If no objection is received in writing within this period, the changes will be deemed accepted.

3.3 A timely objection means that the changes in question will not become part of the contract; the existing contractual relationship will then remain in effect under the previous conditions.

§ 4 Contract duration

4.1 The user agreement between Cyberdoll and the customer is concluded for an indefinite period. The customer may terminate the agreement at any time with fourteen days' notice to the end of the month. Termination must be in writing.

4.2 Cyberdoll is also entitled to terminate the user agreement at any time with fourteen days' notice to the end of the month. This does not affect the right to temporarily or permanently block a customer account.

4.3 The right to extraordinary termination for good cause remains unaffected for both contracting parties.

§ 5 Changes in Function

5.1 Cyberdoll reserves the right to continuously adapt, update, expand, restrict or discontinue individual functions of the platform, insofar as this is necessary to improve the service or for technical, legal or economic reasons.

5.2 The customer agrees to the continuous development and adaptation of the platform in accordance with § 5.1.

§ 6 Copyright, Trademarks and Product Names

6.1 All content on this website, in particular texts, images, graphics and videos, is subject to copyright and other laws protecting intellectual property. Any use, reproduction or distribution, even in part, is not permitted without express written consent.

6.2 All trademarks, product names and logos mentioned on this website are the property of their respective owners and are used solely for the description and presentation of the products and services offered.

§ 7 Services

7.1 Sale of love dolls / sex dolls

7.2 Immediately available love dolls / sex dolls

7.3 Immediately available love dolls or sex dolls are fully manufactured models that cannot be configured. They are generally shipped from the respective manufacturers' warehouses within the EU, for example, from Germany, Spain, France, or other EU member states, or from the USA. In some cases, certain components, such as the head, may be shipped directly from the country of origin, e.g., China.

7.4 After payment is received, shipping is coordinated via a central warehouse in the EU or the USA – depending on the customer's place of residence. Processing and shipping preparation usually take place within 48 hours. After shipment, an E-Mail with tracking information will be sent. Delivery typically takes 7 to 14 business days. This information is non-binding and serves only as a guideline.

7.5 Immediately available love dolls or sex dolls that have not been individually configured are generally subject to the statutory right of withdrawal, provided the packaging is unopened and the goods are unused. For reasons of health protection and hygiene, withdrawal is excluded as soon as the seal has been removed or signs of use or cleaning are visible.

7.6 Returns are only accepted in undamaged original packaging and in a hygienically sound condition. Once the packaging seal has been broken or removed, a return or refund is excluded. In the case of a valid return, the customer bears the return shipping costs.

7.7 For products shipped directly by our manufacturers or external partner companies, www.cyberdoll.de assumes no liability, warranty, or guarantee for the shipping process – in particular, not for transport damage, delivery delays, or loss. In these cases, responsibility for shipping lies with the respective shipping company (e.g., DHL, UPS, TNT, GLS, FedEx, DB Schenker, or others). Any complaints should be addressed directly to the responsible shipping company.

7.8 Configurable Love Dolls / Sex Dolls

7.9 Configurable love dolls/sex dolls are models where the customer can freely choose individual characteristics such as skin color, eye color, hair color, breast shape, genital area, height, or other features. These love dolls/sex dolls are individually manufactured to order and are therefore considered personalized products within the meaning of Section 312g Paragraph 2 No. 1 of the German Civil Code (BGB).

7.10 After receipt and full payment of the order, the individually configured love doll/sex doll will be released for production within 24 hours. From this point on, both cancellation and return are no longer possible. After shipment, you will receive an E-Mail notification including tracking information. Delivery is made directly to the specified address and usually takes up to five weeks, depending on the manufacturer. A binding delivery date cannot be guaranteed. Between mid-November and February, delays in international shipping may occur due to holidays such as Christmas or the Chinese New Year.

7.11 Before shipping, the customer receives detailed photos and videos of the completed love doll / sex doll for final inspection and approval for shipping.

7.12 For products shipped directly by our manufacturers or external partner companies, we, www.cyberdoll.de, assume no liability, warranty, or guarantee for the shipping process – in particular, not for transport damage, delivery delays, or loss. In these cases, responsibility for shipping lies with the respective shipping company (e.g., DHL, UPS, TNT, GLS, FedEx, DB Schenker, or others). Any complaints should be addressed directly to the responsible shipping company.

§ 8 Conclusion of contracts for purchased products

8.1 The products and services presented on the website do not constitute a binding offer, but rather a non-binding invitation to customers to submit a corresponding offer to conclude a purchase agreement.

8.2 The offer is made via the online order form integrated on www.cyberdoll.de. After selecting the desired products (love doll / sex doll), completing all required information, and going through the order process, customers submit a legally binding offer to purchase by clicking the final order button. Before submitting the order, customers must agree to the General Terms and Conditions, the Privacy Policy, the Shipping Conditions, and the Cancellation Policy by activating the corresponding checkboxes.

8.3 All communication – including order processing, support notifications, and optional newsletters (if available) – generally takes place via E-Mail and automated systems. Therefore, providing a correct and permanently accessible E-Mail address is mandatory. Customers must ensure that emails from the provider or its contracted service providers are not blocked by spam filters.

8.4 The contract is concluded exclusively in German. Support can also be provided in English if required.

§ 9 Cancellations, Refunds & Requests for Changes

9.1 Customers can cancel an order within 8 hours of receiving payment. In this case, a flat cancellation fee of 15% of the total price will be charged. This fee covers expenses already incurred.

9.2 If the cancellation occurs more than 8 hours but within 24 hours of receipt of payment, the cancellation fee is 30% of the total price. The amount is based on the expenses already incurred.

9.3 After 24 hours, the individual production of the doll usually begins. Since irreversible production costs are incurred by the manufacturer from this point onward, cancellation is only possible with a retention of 50% of the total price.

9.4 In the event of a very late cancellation – especially after production has begun or shortly before delivery – a refund of the product price is excluded. Only shipping or customs costs not incurred can be partially refunded.

9.5 Refunds will only be issued if repair or replacement is not possible in the case of significant manufacturing defects or irreparable damage.

9.6 Individually configured products

9.7 Configurable love dolls or sex dolls are personalized products where customers can individually select features such as skin color, eye color, hair color, breast shape, intimate area, body size or other features.

9.8 These products are manufactured exclusively according to the individual wishes of the customer and are therefore considered personalized goods in accordance with Section 312g Paragraph 2 No. 1 of the German Civil Code (BGB). There is no right of withdrawal in these cases.

9.9 After receipt and payment of the order, the individually configured love doll or sex doll will be released for production within 24 hours. From this point on, both cancellation and withdrawal are excluded.

9.10 Important for in-stock products: If customers order a product that is immediately available – e.g., from an EU or US warehouse – the order cannot be canceled after payment has been received. These products go directly into the shipping process to ensure the fastest possible delivery.

9.11 Refund & Default of Acceptance

9.12 If, after deduction of any cancellation fees or damages, a refund is due, the remaining amount will be transferred to the original payment method within 7 business days. If a refund via this method is not possible, customers are obligated to provide valid bank details by E-Mail within 5 business days. Failure to provide these details within this timeframe will result in default of acceptance. In this case, the refund amount will be retained; a subsequent refund is excluded.

9.13 Requests for changes after conclusion of the contract

9.14 Customers may submit requests for changes to us by email only within 24 hours after completing their order. After this period, changes are no longer possible because individual production or preparation has already begun.

9.15 Exceptions for stock items

9.16 Products from our EU or US warehouse (marked as “immediately available”) are stock items that cannot be personalised and have not been manufactured to customer specifications. Subsequent changes to appearance, equipment or configuration are therefore not possible.

9.17 No entitlement to subsequent adjustments

9.18 There is no legal entitlement to changes after the 24-hour period or for stock items. This applies regardless of production or shipping status.

§ 10 Shipping by third parties

10.1 For products shipped directly by our manufacturers or external partner companies, we, www.cyberdoll.de, assume no liability, warranty, or guarantee for the shipping process – in particular, not for transport damage, delivery delays, or loss. In these cases, responsibility for shipping lies with the respective shipping company (e.g., DHL, UPS, TNT, GLS, FedEx, DB Schenker, or others). Any complaints must be addressed directly to the responsible shipping company.

§ 11 Youth Protection

Important notice regarding youth protection:
We take the protection of children and young people very seriously. Our goal is to protect them from content that could impair their development. Due to the strict legal requirements for youth protection in Germany, we are obligated to clearly verify the age of majority of our customers before granting them access to uncensored content.

Access to general content on www.cyberdoll.de requires a simple age verification upon entering the website. However, access to uncensored content – especially explicit photos and poses – requires further age verification. This is a one-time, manual process and is free of charge for customers. It serves to definitively verify legal age in accordance with German youth protection laws.

11.1 General access to content:
Upon entering the website, age verification is required via a simple self-declaration form using a pop-up and button. Only then will general access to the content of www.cyberdoll.de be granted. Certain content, particularly uncensored photos and explicit poses, is additionally protected and requires separate age verification as described in sections 11.5 to 11.9.

11.2 Age restriction and youth protection:
The content, offers, and services on www.cyberdoll.de are not pornographic, but are intended exclusively for persons aged 18 and over. The products shown – especially love dolls or sex dolls – may be anatomically realistic and are therefore only intended for adult customers.

11.3 Age verification for transactions:
Our entire range of sales and service offerings is available exclusively to adults. We reserve the right to verify age upon delivery, collection, or handover by requiring presentation of a valid identification document. If proof of age is refused, we reserve the right to refuse service.

11.4 Customer self-commitment:
By submitting an order, inquiry, or entering their date of birth for age verification, customers confirm that they have reached the legally required minimum age of 18. They agree to provide all information – in particular their name, address, and date of birth – truthfully and to ensure that only they themselves or expressly authorized adults use the services and content of this website.

11.5 Age verification for uncensored content (photos & poses):
Access to uncensored content requires a one-time, manual, and free age verification. This involves entering your date of birth to confirm you are at least 18 years old. This information is not stored.

11.6 Access code after verification:
After successful verification, a personal access code will be displayed. This code is non-transferable and must not be shared with third parties – especially minors. The customer is responsible for the secure handling of the code.

11.7 Visibility of uncensored content:
All uncensored content on www.cyberdoll.de is displayed in a blurred form by default. A clearly visible notice and a code entry field are located directly next to each photo. Only after entering a valid code will all protected content be unlocked.

11.8 Data protection & cookies:
No personal data is stored. The access code is managed locally via cookies and remains valid until the cookies are deleted in the browser. No server-side storage takes place.

11.9 Duration and repetition of the verification:
The access code is valid for 24 hours or until the customer deletes the cookies stored in their browser (on their PC or smartphone). After that, age verification is required again.

§ 12 Liability

12.1 Both the customer and Cyberdoll undertake to comply with all contractual obligations of care and diligence necessary for the proper performance of the contract. In the event of a breach of these obligations, claims for damages or reimbursement of wasted expenses may arise.

12.2 Cyberdoll is liable only for damages caused by its own negligence.

Liability exists in particular

- in cases of intent or gross negligence,

- in the case of an expressly assumed guarantee, unless other regulations exist,

- as well as in cases of legally mandatory liability, e.g. under the Product Liability Act.

Furthermore, liability is excluded.

12.3 If Cyberdoll negligently breaches a material contractual obligation (cardinal obligation), liability is limited to the foreseeable damage typical for this type of contract.

12.4 The above liability provisions also apply accordingly to the purchase of products via the platform.

§ 13 Data Protection

13.1 The customer expressly consents to the electronic processing of their personal data in accordance with the following provisions. All customer data will be treated confidentially. The transmitted data will be used exclusively for the needs-based creation of individual offers, for consultation, for contract fulfillment, and for internal market research purposes. Data will not be disclosed to third parties.

13.2 Cyberdoll is committed to complying with data protection regulations, in particular the EU General Data Protection Regulation (GDPR) and all other applicable data protection regulations. The processing of personal data is based on our separate data protection policy.

§ 14 Right of withdrawal

14.1 If the customer is a consumer within the meaning of Section 13 of the German Civil Code (BGB), the statutory right of withdrawal applies. Further details can be found in the separate cancellation policy at:

14.2 If the customer is a company within the meaning of § 14 BGB, the right of withdrawal is excluded.

§ 15 Final Provisions / Severability Clause

15.1 Any side agreements, additions or amendments to this contract must be in writing.

15.2 Cyberdoll is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

15.3 Should any provision of these Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that most closely approximates the economic purpose of the invalid provision.

15.4 In the event that a gap in the regulations exists or arises, an appropriate regulation shall be deemed agreed which comes closest to the economic purpose of the contract and the will of the parties.

15.5 The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). This choice of law shall not apply if it results in consumers being deprived of mandatory consumer protection provisions.

15.6 For all disputes arising from the user agreement and these General Terms and Conditions, the registered office of Cyberdoll in Saarbrücken shall be the exclusive place of jurisdiction, provided the customer is an entrepreneur within the meaning of the German Civil Code (BGB), a legal entity under public law, or a special fund under public law. In all other cases, the statutory provisions shall apply.

§ 16 EU consumer rights, product safety & manufacturer information

16.1 Consumers have statutory rights in the event of a lack of conformity. New goods are covered by a legal guarantee of at least two years from delivery under the applicable statutory provisions. Cyberdoll, as the seller, is the contact for these rights. A voluntary manufacturer's commercial guarantee is separate and does not restrict statutory rights.

16.2 Information about the legal guarantee is provided in the harmonised EU notice in connection with Directive (EU) 2024/825 and Implementing Regulation (EU) 2025/1960. Legal guarantee in the EU

16.3 Article 19 of Regulation (EU) 2023/988 on general product safety (GPSR) sets out information requirements for online offers. These include the manufacturer's identity and postal and electronic contact details, the corresponding details of the responsible person in the EU for manufacturers established outside the EU, information identifying the product and, where applicable, warnings and safety information.

16.4 You can find the manufacturer directory under Manufacturer information. It supplements the product-specific information in the respective offer. A general directory does not replace the required information about the specific product and its responsible person in the EU.

16.5 Statutory rights in the event of a lack of conformity also apply to individually manufactured products and hygiene products. Any exclusion of the right of withdrawal is a separate matter. Mandatory consumer rights remain unaffected.

§ 17 Notice about AI-generated images

17.1 The website uses AI-generated images to illustrate categories and themes, in particular on category and selection cards and in banners. These images are illustrative and are not photographs of a specific product offered for sale.

17.2 AI-generated images may differ from the products actually offered in terms of appearance, proportions, features, clothing, accessories and surroundings. The information about the specific product, the selected configuration and the contractual agreements determine the order.

17.3 This notice does not restrict agreed product characteristics or statutory consumer rights, in particular statutory rights in the event of a lack of conformity.
